The owner of the OMEGAFIT.EE online store is OG Klubi OÜ (registration code 14843593), located in Pärnu county, Tori parish, Sauga village, Hirvela street 9-8, 85008.
Validity of the sales contract, product and price information
The terms and conditions of sale apply to purchases of goods from the Online Store.
The prices of products sold in the online store are indicated next to the products. A delivery fee is added to the price. The prices of all products in the online store are stated in euros.
The delivery fee depends on the buyer’s location and the delivery method. The delivery fee is displayed to the buyer when placing the order.
Information about the product is provided in the Online Store directly next to the product.
Order processing
To order goods, you must add the desired products to the shopping cart. To complete the order, you must fill in the required data fields and select the appropriate delivery method for the products. The amount of the fee will then be displayed on the screen, which can be paid via a bank link or other payment solution.
The Agreement enters into force upon receipt of the amount due to be paid into the Online Store’s bank account.
If the ordered goods cannot be delivered due to the goods being out of stock or for another reason, the buyer will be notified as soon as possible and the money paid (including the costs of delivering the goods) will be refunded immediately, but no later than within 14 days of sending the notification.

Payments are mediated by Montonio Finance OÜ. Payment takes place outside the Online Store in a secure environment – when paying with a bank link, in the secure environment of the respective bank, and when paying with a credit card, in a secure environment by Montonio Finance. The seller does not have access to the customer’s bank and credit card details. The contract enters into force upon receipt of the amount due to be paid to the Online Store’s current account.
The owner of the online store is the controller of personal data and forwards the personal data necessary for making payments to the authorized processor Montonio Finance OÜ.

Goods are shipped to the following countries: Estonia
The buyer bears the shipping costs of the goods and the corresponding price information is displayed next to the shipping method.
Shipments within Estonia generally arrive at the destination specified by the buyer within 1-3 working days from the entry into force of the sales contract.
In exceptional cases, omegafit.ee has the right to deliver the goods within up to 30 calendar days.

Right of withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days [depending on the products, the buyer may not have the right to withdraw, in which case the relevant products and services must be listed and they must comply with the conditions listed in § 53(4) of the Law of Obligations Act].
The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day right of return, the ordered goods may not be used in any way other than what is necessary to verify the nature, properties and functioning of the goods in the manner permitted for testing the goods in a physical store.
If the goods have been used for a purpose other than what is necessary to verify the nature, properties and functioning of the goods or if they show signs of use or wear, the omegafit.ee Online Store has the right to reduce the refund amount according to the decrease in the value of the goods.
To return the goods, you must submit a withdrawal form or a written withdrawal form and send it to the e-mail address [email protected] no later than 14 days after receiving the goods.
The costs of returning the goods are borne by the buyer, unless the reason for the return is that the item to be returned does not correspond to what was ordered (e.g. the wrong or defective item).
The buyer must return the goods within 14 days of submitting the application or provide proof that he or she has handed over the goods to the carrier within the aforementioned period.
Upon receipt of the returned goods, Omegafit will refund to the buyer all fees received from the buyer under the contract without delay, but no later than 14 days after receipt of the withdrawal form.
Omegafit may refuse to make refunds until the item that is the subject of the contract has been returned or until the buyer has provided evidence that they have returned the item, whichever occurs first.
If the buyer has expressly chosen a delivery method other than the cheapest standard delivery method offered by Omegafit , Omegafit is not required to refund the consumer any costs that exceed the costs associated with the standard delivery method.
Omegafit has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the online store is marked significantly below the market price of the goods due to a mistake.
Right to file a claim
Omegafit is liable for any non-conformity or defect of the goods sold to the buyer that already existed at the time of delivery and that becomes apparent within two years of the delivery of the goods to the buyer. During the first six months of the delivery of the goods to the buyer, it is assumed that the defect already existed at the time of delivery. It is the obligation of omegafit.ee to rebut this presumption.
The buyer has the right to contact omegafit.ee within two months of discovering a defect by sending an e-mail to [email protected] or calling +372 5562 2534.
Omegafit is not responsible for defects that have arisen after the goods have been delivered to the buyer.
If the goods purchased from omegafit.ee have defects for which omegafit.ee is responsible, omegafit.ee will repair or replace the defective goods. If the goods cannot be repaired or replaced, omegafit.ee will refund all fees incurred under the sales contract to the buyer.
Omegafit will respond to the complaint submitted by the consumer in writing or in a form that can be reproduced in writing within 15 days.

If the buyer and omegafit.ee are unable to resolve the dispute by agreement, the buyer may contact the Consumer Disputes Commission. You can view the procedural terms and submit an application here. The Consumer Disputes Commission is competent to resolve disputes arising from the contract concluded between the buyer and omegafit.ee. The review of the buyer’s complaint by the Commission is free of charge.
